TTIP, CETA, ISDS -  small words but big challenges for the EU’s trade policy”

Since the release of the “Global Europe” trade strategy in 2006, the European Union (EU) has been pursuing commercially driven trade and investment agreements with partner countries around the world. An agreement with South Korea has already entered into force and negotiations with Singapore, Vietnam and Canada have been concluded. Negotiations with Japan are on their way. The most ambitious project, however, is the Trade and Investment Partnership (TTIP) with the United States. The negotiations for an integrated Trans-Atlantic market were launched in 2013 but they have since faced numerous difficulties. A large number of Europeans are against the TTIP agreement and their resistance is now risking also the ratification of the Comprehensive Economic and Trade Agreement (CETA) with Canada. The controversy relates especially to the inclusion of the investor-state dispute settlement (ISDS) system in the agreements. The European Commission is keen to keep ISDS in its trade and investment agreements and aims at including it also in a possible future investment agreement with China. During the workshop, we will discuss the EU’s current trade policy, the move from multilateralism (WTO) to regional trade agreements and the design of modern trade and investment agreements. 

主讲人简介

Johanna Jacobsson is Associate Professor of Law at IE University and IE Law School (Madrid, Spain). She holds an LL.M. from University of Helsinki (Finland) as well as from the European University Institute (Florence, Italy) and is about to gain a Ph.D. in European and international law from the European University Institute. She also holds a B.A. in Russian and East European Studies from University of Helsinki. Professor Jacobsson currently teaches EU law at IE University, in addition to which she is carrying out research on EU law, international trade law and international dispute settlement. She has previously acted as a law clerk at the Court of Justice of the European Union and been a visiting researcher at the Finnish Institute of International Affairs. Professor Jacobsson has also practiced law in a commercial law firm where her practice focused on dispute settlement (national/EU litigation and commercial arbitration) as well as on competition, employment and general corporate law.

主持人简介

Yuting Hua is currently a Doctrinal Researcher (Ph.D. candidate) at the European University Institute (EUI, Florence, Italy). She holds a Bachelor degree from the China University of Political Science and Law, and a Master degree from the Xi’an Jiaotong University. She also holds an LL.M from the EUI. Her thesis compares China’s bilateral investment treaties (BITs) with the investment chapters in China’s preferential trade agreements. With regard to BITs, the thesis analyses China’s foreign investment rules before and after China’s entry to the WTO in 2001. During her time at the EUI, Ms Hua conducted several interviews with the officials of the WTO (Geneva, Switzerland) and participated in several training seminars in the field of international economic law. She has been certificated as a legal professional lawyer in China since 2008.
